General terms and conditions of shipment

BUBBLESHIP, registered with the REIMS Trade and Companies Register under number [831 637 053], with its registered office at 76 rue Chanzy - 51100 REIMS, is an independent franchisee of the MAIL BOXES ETC. network.
(Effective as of February 1, 2014)

Article 1 – Scope of Application

1.1 These General Shipping Terms and Conditions (GSTC) apply to all shipping contracts entered into between a customer (individual or legal entity, acting for private or professional purposes) (hereinafter "the Client") and BUBBLESHIP, which operates the MBE Center (hereinafter "the MBE Center") located at 15 rue Diderot, 51100 REIMS, as an independent franchisee of the MBE network.
A shipping contract under these terms includes any request for the shipment of goods or merchandise through the MBE Center. BUBBLESHIP acts solely as a forwarding agent and is not responsible for the execution of the transport itself or the actions of the carrier.
The shipping contract may include additional services as outlined in Article 4. These GSTC do not apply to non-shipping services or to product sales unconnected to a shipping contract, which are governed by the MBE Center’s General Terms of Sale.

1.2 The shipping contract also includes the duly completed shipping form, the MBE Center’s price lists, related forms, quotes, and invoices, as well as the General Transport Conditions of the carrier selected by the Client.

1.3 No exception to these GSTC or the shipping contract shall be valid unless expressly accepted in writing by the MBE Center. Any exception to the carrier’s General Transport Conditions must also be accepted in writing in advance by the carrier.

1.4 These GSTC shall prevail over any contradictory documents from the Client.

Article 2 – Execution of the Shipping Contract

2.1 The transport of goods is carried out by the carrier chosen by the Client, as indicated on the shipping form. By entering into a shipping contract, the Client agrees to the carrier’s General Transport Conditions, which are provided to the Client prior to signing the shipping form.

2.2 BUBBLESHIP is not liable to the Client for the execution of the transport and is not responsible for the actions of the carrier or its substitutes.

2.3 Client Obligations
2.3.1 Packaging – Labeling
If the Client does not subscribe to the optional packaging service described in Article 4.1, they are responsible for packing, packaging, and marking goods in a way that ensures safe transport, normal storage, and handling. Packaging must not pose a risk to transport or handling personnel, equipment, other goods, vehicles, or third parties.
Each item must be clearly labeled to allow immediate identification of the sender, recipient, delivery location, and nature of the contents. The Client is liable for any consequences resulting from inadequate or defective packaging, marking, or failure to declare the nature or characteristics of the goods.

The Client agrees not to submit any items that do not meet the carrier's terms and conditions. If such items are handed over, the Client assumes full responsibility, with no recourse against BUBBLESHIP.
Works of art will only be accepted for shipping if the Client purchases a specific insurance policy that includes a waiver of subrogation against Champ’ Expéditions Services and/or the carrier.
No special protection is provided for perishable goods. These are shipped at the Client’s sole risk, and the MBE Center reserves the right to destroy any spoiled items at the Client’s cost and risk.

Article 3 – Customs Clearance

The MBE Center may perform customs clearance operations on behalf of the Client or delegate this task to the carrier. However, compliance with customs regulations remains the Client’s sole responsibility.
The Client shall reimburse the MBE Center on request for any customs-related costs, taxes, or fees or provide an advance payment sufficient to cover them.

Article 4 – Additional Services

4.1 Packaging Service
Clients may purchase packaging services from the MBE Center at the price indicated on the shipping form. If special precautions are needed, the Client must inform the MBE Center in writing; otherwise, the MBE Center cannot be held liable.

4.2 Cash-on-Delivery
If a “Cash-on-Delivery” service is requested, it will be handled in accordance with the carrier’s terms, for which the MBE Center assumes no responsibility.

4.3 Insurance
Clients may purchase insurance directly from the selected carrier. The carrier’s Insurance Terms and Conditions, provided prior to signing the shipping form, specify coverage scope, implementation conditions, and limits.

Article 5 – Delivery Times

Delivery time is chosen by the Client:

Standard: Delivery within 2 to 5 business days from pickup.
Express: Delivery within 2 to 5 business days from pickup.
All timeframes are indicative and in business days. The MBE Center is not responsible for delays caused by the carrier.

Article 6 – Liability

The MBE Center is not responsible for losses, damage, or delays attributable to the carrier.
If the MBE Center is held liable for any reason, compensation is limited to the declared value of the shipment or, if not declared, to €5.00 (incl. VAT) per kg, with a maximum of €55.00 (incl. VAT).
Under no circumstances may the MBE Center’s liability exceed these amounts.

Article 7 – Payment Terms

All services must be paid for upon contract signature by the Client using the payment method indicated on the shipping form.
If a payment delay is granted, it may not exceed 30 days from the invoice date. Late payments will incur interest at three times the legal interest rate plus a fixed €40 recovery fee. If actual recovery costs exceed this amount, additional compensation may be claimed with justification.

Article 8 – Lien

The MBE Center has a contractual lien on all goods entrusted to it, allowing it to retain them as security for full payment of any amounts due by the Client.

Article 9 – Limitation Period

All liability claims related to services provided by the MBE Center must be made within one year from the date of service or, in the case of duties/taxes, from the date of reassessment notice.

Article 10 – Personal Data

Personal data is processed in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR) 2016/679.
Details are provided in the document “Privacy Statement and Consent Request for the Processing of Personal Data,” which must be completed and signed by the Client.

Article 11 – Jurisdiction

In case of dispute, only the Commercial Court of Paris shall have jurisdiction, even in the event of multiple defendants or third-party claims.

Article 12 – Final Provisions

French law governs the entire legal relationship between the Client and the MBE Center. If any provision of these GSTC is deemed void or unenforceable, the remaining provisions shall remain valid and in effect.
